Terms & Conditions

These Terms & Conditions form the agreement between the Client and Paulo Pinto ("the Artist") for the provision of live entertainment services.

By paying the booking deposit and submitting the Booking Form, the Client confirms that they have read, understood, and agree to be bound by these Terms & Conditions.


1. Booking Confirmation

A booking is confirmed once:

  • The booking deposit has been received in cleared funds; and
  • A Booking Agreement has been issued and emailed to the Client.

Until both conditions are met, the requested Event Date remains available for other bookings.


2. Deposit

A non-refundable booking deposit of £150 is required to secure the Event Date.

The booking deposit forms part of the total agreed fee and will be deducted from the final balance.

The booking deposit is strictly non-refundable, except where otherwise required by law.


3. Fees & Payment

All fees shall be agreed in advance and confirmed in writing.

  • The remaining balance is due no later than 14 days before the Event Date, unless otherwise agreed in writing.
  • Failure to make payment by the due date shall constitute a material breach of this Agreement and shall be deemed a cancellation by the Client.
  • Any cancellation arising from the Client's failure to make payment shall be treated as a cancellation by the Client and Section 4 shall apply in full.
  • Any monies due under Section 4 shall remain payable irrespective of whether the Event proceeds with an alternative performer or entertainment provider.

4. Cancellation by the Client

All cancellations must be submitted in writing by email.

If the Client cancels the booking:

  • More than 60 days before the Event Date, no further charges shall apply beyond the loss of the non-refundable booking deposit.
  • Between 30 and 60 days before the Event Date, 50% of the outstanding balance shall become immediately due and payable within 24 hours.
  • Within 30 days of the Event Date, the full outstanding balance shall become immediately due and payable within 24 hours.

The booking deposit is non-refundable under all circumstances.

The Client acknowledges that the Artist is in high demand and reserves the Event Date exclusively for the Client and may decline alternative bookings as a result. The above cancellation charges represent a genuine pre-estimate of the loss likely to be suffered by the Artist arising from the cancellation and are not intended as a penalty.


5. Date Changes

Requests to change the Event Date must be submitted in writing by email and are subject to the Artist's availability.

Where a revised date is agreed and the request is received more than 30 days before the original Event Date, the booking deposit may be transferred to the new date at the Artist's sole discretion.

Where the Artist is unavailable on the proposed new date, or where the request is received within 30 days of the Event Date, the booking shall be deemed a cancellation by the Client and Section 4 shall apply in full.

The Artist reserves the right to decline any request for a date change at their sole discretion. Where a request for a date change is declined and the Client is unable or unwilling to proceed with the original Event Date, the booking shall be deemed a cancellation by the Client and Section 4 shall apply in full.


6. Performance Requirements

The Client agrees to provide a safe and suitable performance area in accordance with the performance package and space requirements specified in the Booking Agreement.

The Client further agrees to provide:

  • Access to a suitable power supply (minimum two standard 13-amp mains sockets).
  • Reasonable access for setup and pack-down.
  • Appropriate protection and cover for outdoor performances.

The Artist reserves the right to assess the suitability of the performance area upon arrival.

If the agreed performance space, access, power supply or other setup conditions are not provided, the Artist reserves the right to delay, modify, suspend or cancel the performance without liability for any resulting loss.


7. Venue Restrictions

The Client must advise the Artist in advance of any:

  • Sound limiters or volume restrictions.
  • Curfews or time limitations.
  • Access restrictions or venue regulations.
  • Any other conditions that may affect performance delivery.

Where such restrictions materially affect the performance, the Artist reserves the right to amend, modify or decline the booking.


8. Outdoor Performances

Outdoor performances are subject to suitable weather conditions and appropriate cover.

The Artist reserves the right to pause, modify or terminate the performance where weather conditions present a risk to personal safety, equipment, guests or venue property.


9. Performance Schedule

Performance times and set structures shall be selected by the Client during the booking process and confirmed in the Booking Agreement.

The Artist may make reasonable adjustments to timing, set structure or performance flow where necessary to accommodate venue restrictions, operational requirements or unforeseen delays, whilst ensuring the best possible event experience.


10. Health, Safety & Conduct

The Client is responsible for ensuring that:

  • Guests remain outside the performance area.
  • Children are appropriately supervised at all times.
  • Equipment and performance areas remain clear and unobstructed by guests, staff or any items, including but not limited to clothing, bags, drinks, food or personal belongings.
  • No interference takes place with sound, lighting or any other performance equipment, including haze machines where provided.

The Artist reserves the right to suspend or terminate the performance if behaviour is considered unsafe, abusive, disruptive or presents a risk to persons, equipment or property.

No refund shall be due where the performance is suspended or terminated for safety reasons.


11. Equipment & Liability

Unless otherwise agreed, the Artist will provide professional sound and lighting equipment.

Haze effects are available upon request and subject to venue approval.

The Artist shall not be responsible for:

  • Venue electrical faults or infrastructure failures.
  • Failure or malfunction of third-party equipment.
  • Restrictions imposed by the venue.
  • Damage caused by venue conditions, guests or third parties.

The Client may be held responsible for any damage caused through negligence, misuse or unauthorised interference with the Artist's equipment.


12. Insurance

The Artist maintains appropriate Public Liability Insurance and PAT-certified equipment where applicable.

Documentation is available upon request.


13. Travel

Where applicable, travel and accommodation costs are included within the agreed quotation.

Additional travel, accommodation, parking or logistical costs arising from changes requested by the Client after booking confirmation may be chargeable.


14. Force Majeure

The Artist has never cancelled an event in over 20 years of professional service. However, the Artist shall not be liable for any failure, delay or interruption in performance due to circumstances beyond reasonable control, including but not limited to:

  • Sudden illness or injury.
  • Severe weather conditions.
  • Transport disruption.
  • Government restrictions.
  • Venue closure.
  • Acts of God.
  • National emergencies or other unforeseen events.

In such circumstances, the Artist shall be entitled to cancel or suspend the performance without liability for non-performance.

Where reasonably possible, the Artist may (but is not obliged to) use reasonable endeavours to reschedule the booking or recommend a suitable professional replacement.

The Artist shall not be liable for any indirect loss, consequential loss or loss of enjoyment arising from such cancellation or non-performance.

Any refund, where applicable, shall be limited to monies received less any non-recoverable costs already incurred in preparation for the Event.


15. Promotional Activity

The Artist may reasonably promote professional services during the Event, provided such activity does not interfere with the Client's enjoyment of the Event.

This may include:

  • Discreet signage or branding.
  • Business cards or promotional literature.
  • Sale or promotion of professional merchandise or recorded media.

All promotional activity shall remain professional, proportionate and respectful of the Event environment.

Where venue policies prohibit such activity, the Artist will comply once informed.


16. Coordination with Suppliers

The Artist may liaise directly with venue staff, event planners, DJs, photographers, videographers and other suppliers where necessary to facilitate the smooth running of the Event.

This may include coordination relating to:

  • Venue access and setup.
  • Event timings.
  • Technical requirements.
  • Announcements.
  • Overall event flow.

All communication shall remain professional and focused on the successful delivery of the Event.


17. Photography, Video & Promotional Use

The Artist may use photographs, video recordings, audio recordings, testimonials, reviews or other media captured during the Event for promotional, marketing, website, social media, portfolio and business development purposes.

Where the Client requires restrictions on the use of such material, these must be requested in writing before the Event Date.

The Artist will make reasonable efforts to accommodate such requests where practicable.
